The United States is facing another debate over birthright citizenship after President Donald Trump signed two executive orders on August 6 aimed at limiting automatic citizenship at birth.

One order expands the groups the administration says may not qualify for automatic US citizenship. This includes children linked to foreign governments or certain designated terrorist organizations. The second order focuses on ‘birth tourism’ and aims to stop entry for people believed to be travelling to the US mainly to give birth there.

The latest changes are expected to face legal challenges. Trump had also signed a broader order on birthright citizenship in January 2025, but the courts stopped it before it could take effect.

While the US continues to debate birthright citizenship, Canada has moved in a different direction. Changes to Canadian citizenship rules have made it possible for more people with Canadian family connections to claim citizenship.

Canada Opens Citizenship To More Family Members

On December 15, 2025, changes to Canada’s Citizenship Act under Bill C-3 came into effect.

The changes allow Canadian citizenship to pass through family lines to more generations born outside Canada. This can include grandchildren, great-grandchildren, and later generations, depending on when they were born and whether the family meets the required conditions.

People born outside Canada before December 15, 2025, may already be Canadian citizens if they can show an unbroken family connection to a Canadian citizen or Canadian-born ancestor.

For people born after December 15, 2025, additional rules apply. Their parent(s) may need to show at least 1,095 days of physical presence in Canada before the child’s birth.

The rule changes have led many Americans to look more closely at their family history. Thousands have applied for proof of Canadian citizenship, even though many have no immediate plans to move to Canada.

How Does Canadian Citizenship By Descent Work?

Bill C-3 does not create a normal application to become a Canadian citizen.

A person who already meets the citizenship rules through family connections may already have Canadian citizenship. The main document needed is a Canadian citizenship certificate, which confirms that status.

Applicants generally need to prove the family connection between themselves and their Canadian-born ancestor.

This can require documents for each generation in the family line. Birth certificates, marriage certificates, and documents showing legal name changes can help establish the connection.

After collecting the required documents, applicants can complete the relevant application and submit the required documents to Canada’s citizenship department.

Current applications for proof of citizenship can take around 19 months to receive a decision.
